Terms and Conditions – JN Plant & Transport

1. Introduction

Welcome to JN Plant & Transport. These terms and conditions outline the rules and regulations for using our services and website. By hiring our equipment or using our services, you accept these terms and conditions in full. Please read them carefully before proceeding with any bookings or services.

2. Services

JN Plant & Transport provides a range of services, including plant and machinery hire, earthmoving services, roadworks, and infrastructure maintenance. Each service is designed to meet specific client needs and is subject to these terms and any additional terms provided during the service agreement process.

3. Booking and Payment

  • All equipment and service bookings require a signed agreement and payment of a deposit.
  • Full payment must be made according to the terms specified in the service agreement before equipment is released or services commence.
  • Payments can be made via bank transfer or other accepted methods. Proof of payment must be sent to our accounts department.
  • JN Plant & Transport reserves the right to cancel any booking if payment is not received within the agreed timeframe.
  • A cancellation fee may be applied if a booking is canceled after payment has been made.

4. Cancellation and Refunds

  • Cancellations made more than 7 days prior to the start of the hire period will receive a full refund, minus a 10% administration fee.
  • Cancellations made less than 7 days before the hire period will incur a 50% cancellation fee.
  • No refunds will be issued for cancellations made less than 48 hours before the hire period.
  • Refunds for early termination of hire are at the discretion of JN Plant & Transport.

5. Hire Terms and Conditions

  • Equipment Responsibility: All equipment is hired out on the basis that it will be used responsibly and only for its intended purpose. The hirer is responsible for the equipment from the time of delivery until it is returned or collected.
  • Damage or Loss: The hirer is liable for any damage, loss, or theft of equipment during the hire period. A repair or replacement fee will be charged accordingly.
  • Inspection of Equipment: The hirer agrees to inspect the equipment upon delivery to ensure it is in proper working condition. Any faults or damages should be reported immediately.
  • Return of Equipment: The hirer must return the equipment in the same condition as it was delivered. Late returns may result in additional charges.
  • Fuel and Maintenance: The hirer is responsible for fuel costs during the hire period. Basic maintenance, such as checking oil and water levels, should be carried out daily. Any issues must be reported immediately.

6. Safety and Compliance

  • JN Plant & Transport is committed to maintaining a safe work environment. All equipment is regularly inspected and maintained to ensure compliance with safety regulations.
  • The hirer is responsible for ensuring that the equipment is operated by trained and qualified personnel.
  • The hirer agrees to follow all safety guidelines provided and to operate the equipment in accordance with the manufacturer’s instructions.
  • JN Plant & Transport reserves the right to terminate the hire agreement if safety practices are not followed.

7. Liability

  • JN Plant & Transport is not liable for any injury, loss, or damage incurred during the use of our equipment or services. The hirer assumes full responsibility for the safe operation of the equipment.
  • We will not be liable for any indirect, incidental, or consequential damages arising from delays or failure to perform services.
  • JN Plant & Transport’s total liability shall not exceed the amount paid by the hirer for the service or hire period in question.

8. Insurance

  • The hirer is advised to have adequate insurance coverage for the hired equipment, including third-party liability.
  • JN Plant & Transport holds insurance for its own property but is not responsible for any damages or claims that arise from the use of hired equipment by the hirer.

9. Electronic Communications and Transactions Act Compliance

9.1 Data Messages
Data Messages are considered received when we acknowledge them. Electronic signatures, encryption, and authentication are not required for valid communication between users and our company.

9.2 Information as Required by the ECT Act
